In short: These are the standard terms we work under. They cover what you're subscribing to, how billing works, what you can expect from the service, what happens if something goes wrong, and how to cancel. We keep them short, fair, and free of small print.
1. About these terms
These terms apply when you subscribe to a service from Beachdog Solutions Limited ("we", "us") or engage us to build a custom app ("the client", "you"). They form the standard basis of our working relationship. Where we send you a written plan confirmation or a custom-app scope, that document sits on top of these terms — if anything in it conflicts with what's here, that document wins.

By subscribing — starting a plan, paying an invoice, or confirming your setup in writing — you agree to these terms.
2. What we provide
We provide subscription software for businesses. Mainly:
- Our restaurant point-of-sale (POS) system, offered as a monthly subscription across our Solo, Pro, and Premium plans
- Done-for-you setup of your menu, floor, workflow, and devices as part of onboarding
- Custom-made business apps built around your specific workflow (booking systems, inventory, dashboards, internal tools)
- Ongoing updates, support, and changes for the duration of your subscription
We do not:
- Take any percentage or cut of your sales or transactions
- Charge you per outlet — a plan's price is flat regardless of how many locations it covers
- Offer marketing, design-only work, or business consulting unrelated to the software
3. Plans & setup
Our POS is offered on three plans — Solo, Pro, and Premium — each billed monthly. The current plans, what each includes, and their prices are shown on our pricing page. Every plan includes the full core system; higher plans add scale (multiple devices and outlets) and level of service.
Setup: before you go live, we set the system up around how you actually work — your menu, floor plan, tax and service charges, printers, and devices. On the Pro and Premium plans this is done for you; on Solo it's more hands-on, with our help by email. Setup is included in your subscription — there is no separate one-off build fee for the standard POS.
4. Billing & payment
How billing works
- Plans are billed monthly, in advance. Your subscription renews automatically each month until you cancel.
- Your first payment is due when your plan starts. Each following payment is due on your monthly renewal date.
- Prices are shown on the pricing page and confirmed in writing when you start a plan. We'll give you clear notice before any price change takes effect; a price change never applies to a month you've already paid for.
Currency & methods
All plans are priced and charged in Hong Kong Dollars (HKD), the legal billing currency of Beachdog Solutions Limited. Any other currency shown on our site is an indicative conversion for reference only — the amount charged is always in HKD. Where we show accepted payment methods, we confirm them with you when your plan starts. Any bank or card fees on your end are your responsibility; we cover fees on our end.
Late or failed payment
If a subscription payment fails or is overdue, we'll let you know and give you a short window to update it. If a payment remains unsettled after that window, we may suspend access to the service until it's brought up to date. We don't add late fees.
5. Changing your plan
You can move up or down between plans as your business changes.
- Upgrading (e.g. Solo → Pro) takes effect right away; we adjust your next invoice to reflect the new plan.
- Downgrading takes effect from your next monthly renewal, so you keep the features you've paid for until then. Some features may no longer be available on a lower plan.
- We'll always confirm a plan change in writing before it changes what you're billed.
6. Your data & the software
Your business data — your menu, sales, customers, and settings — is yours. We don't sell it, and we don't use it for anything other than running the service for you (see Section 11).
- While you're subscribed, you have full use of the software for your business.
- The software itself, including its underlying code and design, remains the property of Beachdog Solutions Limited. A subscription grants you the right to use it, not ownership of it.
- If you cancel, you can request an export of your data in a common format within 30 days of cancellation. We'll provide it within a reasonable period, after which your data may be deleted in line with our Privacy Policy. We may reference your business anonymously as a case study (e.g. "a restaurant in South-East Asia") — never with your name, location, or identifying details unless you give written permission.
7. Availability & support
- The single-device POS is designed to keep working through a connection drop during service.
- Support is included in your subscription. For urgent issues (the system is down during service) we respond as quickly as we can during business hours; non-urgent issues, within a couple of business days.
- We roll out updates and improvements over the life of your subscription at no extra charge.
- We don't offer 24/7 on-call coverage as standard. Where you need a bespoke support arrangement, we can agree that separately.
8. Custom app engagements
Custom-made apps (things outside the standard POS) are agreed case by case. Before any custom work starts, we send you a written scope describing what the app does, what it doesn't, the price or price range, the expected timeline, and any third-party services involved. Custom engagements may be billed as a subscription or as an agreed piece of work — whichever we set out in that scope. If you want to add or change features once we've started, we'll send a short revised scope showing the impact and only proceed once you've approved it. We never silently add costs.
Who owns what
Ownership depends on which product you're using — and the two are different:
- A custom-made app — you own it. When you commission a bespoke app and pay for it in full, the finished app is yours. On full payment, the rights to the custom application we built specifically for you transfer to you. We may keep the rights to generic, reusable building blocks and tools underneath it (libraries, frameworks, utility components we use across projects), but the delivered app itself is the client's.
- The Beachdog POS — you licence it. The POS is subscription software, not a bespoke build. Subscribing gives you the right to use it, not to own it; the POS software and its code remain the property of Beachdog Solutions Limited (as set out in Section 6). Setup and configuration we do for your restaurant don't change that — the underlying system stays ours.
In short: buy a custom app and you own it; subscribe to the POS and you licence it.
9. Your responsibilities
To get the best outcome, we need a few things from you:
- Timely input during setup — your menu, floor, tax details, and the accounts or devices we need to get you live
- One main point of contact — someone we can reach for decisions; if several people need to weigh in, you coordinate that internally
- Keeping your payment details current so the subscription doesn't lapse
- Honesty about how you operate — we set the system up better when we understand the real workflow, even the messy parts
10. Third-party services
Your setup may involve third-party services (payment providers, delivery platforms, hardware suppliers, hosting). Where these are your own accounts, they remain your responsibility:
- You pay any fees those providers charge directly to them, never to us
- If a provider changes pricing, terms, or shuts down, we'll help you adapt where we can
- We tell you upfront which third-party services your setup relies on
- We're not responsible for outages, bugs, or breaches at third-party services
11. Confidentiality
Anything you share with us — your data, business processes, customer information, financials, internal documents — we treat as confidential. We don't share it with anyone except where:
- It's necessary to deliver the service (e.g. a third-party service needs your data to function)
- You give us written permission
- We're legally required to disclose it
This applies during and after your subscription — indefinitely.
12. Liability
We do our work carefully and stand behind it. But software is software, and we have to be realistic about what we're liable for:
- Our total liability is limited to the total fees you paid us in the 12 months before the event giving rise to the claim
- We're not liable for indirect or consequential damages — lost profits, lost business, or lost data caused by issues outside our control
- We're not liable for issues caused by changes you (or another party) made outside the service
- We're not liable for third-party service outages, bugs, or pricing changes
This doesn't limit our liability for fraud, gross negligence, death or personal injury caused by our negligence, or anything else that can't be limited under applicable law.
13. Cancellation & termination
If you want to cancel
- You can cancel at any time by emailing info@beachdogsolutions.com, with no need to give a reason. Cancellation takes effect at the end of your current paid month — you keep access until then.
- We don't charge a cancellation fee, and we don't lock you into long contracts.
- Monthly payments already made aren't refunded on a partial-month basis, but you won't be billed again after you cancel.
- If you cancel, you can request an export of your data in a common format within 30 days of cancellation. We'll provide it within a reasonable period, after which your data may be deleted in line with our Privacy Policy (see Section 6).
If we suspend or cancel
We may suspend or end your service if:
- Payments remain unsettled after we've followed up
- The service is used unlawfully, or in a way that harms our systems or other users
- Continuing would require us to do something illegal or unethical
Where we end a subscription for reasons other than misuse, we'll give you reasonable notice and the chance to export your data.
14. Governing law
These terms are governed by the laws of Hong Kong, where Beachdog Solutions Limited is registered (Business Registration Number 80331607). Any disputes arising from these terms or from services provided under them are subject to the non-exclusive jurisdiction of the courts of Hong Kong.
If we can't resolve a dispute amicably, we agree to first attempt mediation before any legal action.
Where mandatory consumer-protection law in your own country applies to you, nothing in these terms removes rights you have under that law.
15. Changes to these terms
We may update these terms from time to time. When we do, we'll post the new version here with an updated date and, for material changes, tell you in advance. Continuing to use the service after an update takes effect means you accept the updated terms.
